AMENDMENT TO ORDINANCE NO. 290 AN ORDINANCE AMENDING CITY OF OZARK ORDINANCE NO. 290; DECLARING AN EMERGENCY THEREFORE; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OZARK, ARKANSAS THAT: SECTION 1: There shall be added and included in Ozark Ordinance No. 290 a paragraph designated "Section 7" which shall read as follows: "Section 7 If any person, partnership, corporation, or other legal entity receives three notices or demands from the Mayor that their property does not comply with Ozark Ordinance No. 290 and within a period of two years, then at the time of the issuance of the third notice of non-compliance, the individual, partnership, corporation or other legal entity shall be subject to a penalty of not less than $250.00. Thus, along with the third notice to comply, a citation shall be delivered by a duly acting city police officer notifying the violator that he has been cited for the violation of "repeated failure to maintain the property" in accordance with this Ordinance and establishing a date for which the alleged violator must appear before the Ozark Municipal Court to defend the charge. This penalty provision shall be separate and distinct from other penalty provisions contained in this Ordinance and pertaining to failure to remedy the violation or come into compliance within the requisite time after receiving due notice. SECTION 2: It being necessary for the preservation of the public peace, health, and welfare, this Ordinance shall be deemed in full force and effect immediately upon its passage.
